TERM & CONDITION

Villanesia is the trading name for the company registered as name PT Jetwings Bali. All properties listed on Villanesia website are offered for short term holiday rental from their Owner or their legal representative (the “Owner”) to the renter (the “Client”) under the following Terms and Conditions. Please note that some properties will also have THEIR OWN Specific Rental Conditions, available on the page of each property on Villanesia. In some instances, Villanesia acts as an agent for the Owner and will provide an online platform which Owners can advertise their properties. The agreement between Villanesia and the Client is only valid once either a deposit or full payment is received from the client either by credit card or by bank transfer and the booking has been confirmed by Villanesia to the Client.

Villanesia may, in its sole discretion, choose to not process or to cancel your reservation in certain circumstances. This may occur, for example, when the booking you wish to reserve is no longer available or has been mispriced, we suspect the reservation request is fraudulent, or in other circumstances Villanesia deems appropriate in its sole discretion. Villanesia also reserves the right, in its sole discretion, to take steps to verify your identity to process your reservation. Villanesia will either not charge you or refund the charges for reservations that we do not process or cancel.

In rare cases, a property may be available when a customer places the order, but becomes unavailable prior to check-in. If this should occur, your sole remedy shall be to contact Villanesia to make alternative arrangements or to cancel your reservation and this connection, you hereby agree and covenant that you shall not hold Villanesia for any loss and/or damages that you may suffer as a result of the occurrence of the above event.

While Villanesia will endeavor to provide accurate descriptions of the products and/or services offered on Villanesia site, Villanesia does not warrant that the description are accurate, complete, reliable, current or error-free.

While Villanesia strives to provide accurate pricing information regarding the products and/or services available on Villanesia site, we cannot, however insure against pricing errors or pricing changes. Villanesia reserves the right, at its sole discretion, not to process or to cancel any bookings placed for a product or service whose price was:

  1. Incorrectly provided as a result of an error, or
  2. changed by the service provider.

In the event of either of the above events occurring, Villanesia will notify you by email and correct the pricing on Villanesia site. If additional charges apply to your booking including but not limited to the addition of an extra traveler, property fees or other taxes or incidentals, which have not been levied at the time of your booking with us, you will be responsible for paying these charges directly to the service provider. For the avoidance of any doubt, Villanesia does not guarantee that it offers the best available rates for products and/or services available on Villanesia site.

Cancellation and amendment to reservation very depending on the property. At the time of booking, you will be provided with the relevant terms and conditions. With respect to other services and reservation on Villanesia, the rules and restrictions regarding your reservation, as described on the relevant site at the time you make the reservation, will specify whether you may be able to cancel or amend your reservation. If an amendment to or cancellation of your reservation is permitted, you may be charged a cancellation or amendment fee. You agree to pay any cancellation or amendment fee that you incur.

To the extent you are eligible to cancel or amend your reservation, such cancellation is subject to the property’s cancellation policy noted in your booking confirmation or otherwise provided to you. To the extent any credit or refund is due, such amount will be refunded to you in the original form of payment i.e., either Villanesia credit or credited back to the payment card which we originally charged for your booking. All refunds will be paid in the currency in which you originally paid for the booking, as specified by us.

You may not sell, auction, barter of transfer your reservation to a third party.

Property Owner may impose additional rules and restrictions on products and services available through Villanesia site. Please read these additional terms and conditions carefully. By purchasing products and/or services through Villanesia site, you agree to abide by such additional rules and restrictions, such as the payment of all amounts when due and compliance with the property owner’s rules and restrictions regarding availability, minimum age, maximum occupancy, pet policies, child policies and use of fares, products or services. You shall also agree that any breach or contravention of any such property owner’s rules and restrictions may result in cancellation of your reservation, in being denied access to the applicable travel products or services, in forfeiting any charges paid for such reservation, and in being charged by us for any costs we incur as a result of such said breach or contravention.

The sales or other taxes charged in connection with your booking depend on the location of the event, property, any rules governing those property owners, or other requirements. Property owners may also charge service fees. You will be able to view the taxes and additional service fees included in a booking before confirming the booking.

Villanesia bookings do not include any incidental charges, expenses or services, except as specifically described in your itinerary. You are liable for any such incidental charges, expenses or services that you incur or consume during your trip.

Save for cases where our partner or affiliates provide a different payment policy, all reservations booked through Villanesia shall be paid in accordance with the payment policy allocated to the booking. You agree to pay Villanesia the fees, costs, expenses, fees and other charges in connection with your reservation. You further acknowledge and agree that the charges will be billed to your payment card, or that you will pay the charges using another payment method.

In case of those of our partner or affiliates who have a different booking format and payment policy in that the guest shall settle all payments directly with such said partner of affiliate, Villanesia in some case be authorized to accept a booking deposit from guests booking through Villanesia site. However, the remainder or all of the costs shall be settled by the guest directly with our partner or affiliate upon checkout.

Given the nature of travel services, we recommend that you obtain independent insurance to provide adequate cover for medical expenses, personal accident, loss of baggage and curtailment or cancellation of your trip. Please note that such insurance is not included in your purchase on Villanesia unless you separately purchase such insurance on Villanesia (where available).

Once the full payment is received, the Guest shall be sent a reservation voucher by Villanesia with confirmation details, the Property’s address, contact details of the Villanesia representative, transfer arrangements, and directions to the Property. This voucher, along with the Guest’s passport, needs to be presented upon arrival for check-in.

Standard check-in and check-out times for villas are 2pm and 12pm (noon) respectively unless stated otherwise. Villanesia will work with the Owner or Owner’s Representative to try and accommodate the Guest’s actual arrival and departure times, subject to availability. Please notify Villanesia of a change in your arrival or departure schedule for us to be able to accommodate a change where possible

A security deposit may be payable directly to the Owner or Owner’s Representative immediately upon arrival at the Property. The standard security deposit required for each Property is stated in the Property description; however, the Owner has the right to impose different requirements on a case-by-case basis. Access to the Property may be refused if the security deposit is not paid in full. When the security deposit is required to be paid in cash, or when a non-standard security deposit applies, Villanesia will inform the Guest in advance of the amount payable and any other conditions.

The security deposit will normally be refunded at the end of the rental period for property, after deducting:

  • All additional expenses incurred on the Guest’s behalf (e.g. charges for food, goods, services, and additional staff such as babysitters and fitness instructors, which have not been directly paid by the Guest, and telephone and internet charges, if applicable).
  • The cost of replacement or repair of any loss or damage to the Property or its surrounds or contents caused during the Rental Period. If this cost cannot be reasonably determined prior to the Guest’s departure, the Owner or the Owner’s Representative are entitled to withhold a reasonable estimate from the Guest’s security deposit and will return any balance to the Guest as soon as possible after the actual cost has been determined.

A Property is typically someone’s home. Please treat the booked Property accordingly, and leave the Property and all its contents in good order and an acceptably clean condition.

Any damage or loss caused during the Rental Period, as well as any special cleaning requirement due to negligence of anyone in your group, will be the Guest’s responsibility and may be charged to the Guest’s account and deducted from the security deposit. In cases of excessive or unacceptable loss or damage at any time during the Rental Period, Villanesia may require the Guest and their party, including visitors, to vacate the Property immediately, without compensation or refund.

Every attempt will be made for the guest to have an enjoyable stay. If you have a problem during the rental period, please inform Villanesia and we will try to put things right. For complaints to be addressed, the guest must communicate any problem whilst on location. If no complaint is reported during the rental period, Villanesia will assume that the property was to the guest’s satisfaction and no complaint will be entertained later.

Self-catering accommodations require guests to arrange for all provisions and consumables necessary for daily living. The staff at the property may accommodate any reasonable requests to purchase provisions on your behalf, and this will be charged to the guest account.

The Property and its facilities are available for the Guest’s full enjoyment during the duration of stay. However, the Owner, Owner’s Representative, or other staff and contractors may need access to the Property from time to time (e.g. for maintenance of the house, garden, swimming pool, utilities and services, or for providing additional services requested by the Guest, etc.). You are required to give them reasonable access to the Property for these purposes.

The number of persons (adults and children) staying at the Property must not exceed the maximum number of sleeping places indicated in the booking confirmation and reservation voucher unless specifically authorized in writing by Villanesia. Exceeding this number may invalidate any insurance policy on the Property. Entry or access to the property may be refused or limited where the number of guests exceeds the stated requirement. Chalets in Japan require at least one resident guest to be aged 25 years or over. No pets are allowed unless agreed in writing in advance.

All bookings are assumed to be for normal holidaying purposes only, and the Guest agrees that the use of the Property will be limited to this purpose unless otherwise confirmed in writing. If the Guest is planning to hold an event such as a wedding or a party that involves having a larger number of people at the Property, or if the Guest is planning to use the Property for a purpose other than a holiday, please communicate this to Villanesia at the time of booking, as special approval or arrangements may be required.

Guests are responsible for all their valuables and personal items. Neither Villanesia nor the Owner or the Owner’s Representative accepts any responsibility for loss of or damage to Guest property. The Guest is responsible for the Property during the Rental Period and must ensure that all windows and doors are locked securely when not on the premises. Any act or commission by the Guest, their party and/or visitors which may negate or prejudice the Property’s insurance policy and/or results in loss or damage is the Guest’s responsibility.

Once a booking is confirmed, the price of the reservation is fully guaranteed, even if Villanesia changes the price on its website thereafter. In return for this commitment, no refunds will be made for any exchange rate fluctuation that may otherwise reduce the rental cost. Villanesia reserves the right to impose any taxes or other charges which may be implemented by a government or other regulatory body, which were unknown at the time of publishing. Villanesia will tell the Guest promptly in the unlikely event that it becomes aware of any additional taxes or charges that will apply to the Guest’s booking.

As a host, you are responsible for determining and fulfilling your obligations under applicable lawas to report, collect, remit, or include in your price any applicable government taxes, occupancy taxes, tourist, income, or other taxes.

The descriptions, assessments and/or ratings of properties and surrounding locations that Villanesia publishes or gives to the guests are provided in good faith and in the belief that they are accurate based on the latest information received. However, Villanesia cannot be held responsible for any last-minute modifications to the properties or inaccuracies. Where Villanesia publishes or refers to descriptions, assessments, and/or ratings of the property either by Villanesia or by third parties, these ratings are for information purposes only and Villanesia will not be held responsible for any reliance placed on these ratings.

Villanesia, does not accept any responsibility or liability for:

  • Any physical injury, sickness, death, loss, damage, inconvenience or additional expenses incurred by the guests, their party or visitors regardless of the cause;
  • Any vehicle or the contents of any vehicle used, hired or engaged by the guest or their party during the rental period;
  • Inability of the Guest or any member of the guest’s party to enter the location of the property for all or part of the rental period as a result of failure to obtain appropriate travel or visa documentation, cancellation or amendments to travel arrangements or the missing of flights or travel connections; and/or
  • Strife, strike, demonstration, terrorist activity (threatened or actual), natural disaster, fire, sickness, weather conditions, action at an airport or port by any government or public authority, technical problems relating to transport and airport regulations caused by technical, mechanical or electrical breakdowns, or any technical, structural, electrical, plumbing or other problems or difficulties with the property which make it unsafe or unusable, or any other circumstances which amount to force majeure or Acts of God, or other events beyond the owner’s control.

In no case will Villanesia, the owner’s representative individually or collectively be liable to make any payment or give any refund or compensation of any amount over and above the total rental amount paid.

This agreement will be governed by the laws of Indonesia. In the event of controversy arising from the booking and stay that cannot be resolved amicably between the parties, both parties agree to exclusively refer the matter to the laws of Indonesia.

By making a booking request, the guest agrees that these terms and conditions have been read, understood and have been accepted and agreed to without reservation and without exception.

If any of the conditions of this rental contract are or become or are deemed to be invalid, or if there is any omission from any terms and conditions, the remaining terms and conditions will remain valid and enforceable and cannot be contested.

As a host, Villanesia offers you the right to use the Villanesia Platform to share your accommodation, experience, or other host service with our guests and earn money doing it. It’s easy to create a listing and you are in control of how you host – set your price, availability and rules for each listing.

When you accept a booking request, or receive a booking confirmation through the Villanesia Platform, you are entering into a contract directly with the guest, and are responsible for delivering your host service under the terms and at the price specified in your listing. You are also agreeing to pay fees based on commission agreed to Villanesia and applicable taxes for each booking. Villanesia payment will deduct amounts you owe from your payout unless we and you agree to a different method. Any terms, policies or conditions that you include in any supplemental contract with Guest must be consistent with our terms and the information provided in your listing, and be prominently disclosed in your listing description.

Villanesia provides tools that make it easy for you to set up and manage a listing. Your listing must include complete and accurate information about your host service, your price, other charges like cleaning fees, property fees, offline fees and any rules or requirements that apply to your guest or listing. You are responsible for keeping your listing information (including calendar availability) and content (like photos) up-to-date and accurate at all times. We recommend that you obtain appropriate insurance for your host services and suggest you carefully review policy terms and conditions including coverage details and exclusions. You may only maintain one listing per accommodation, but may have multiple listings for a single property if it has multiple places to stay.

You are responsible for understanding and complying with any laws, rules, regulations and contracts with third parties that apply to your listing or host services. For example: some landlords and leases, or homeowner and condominium association rules, restrict or prohibit subletting, short-term rentals and/or longer-term stays. Some areas have zoning or other laws that restrict the short-term rental of residential properties. Some jurisdictions require hosts to register, get a permit or obtain a license before providing certain host service such as short-term rentals, longer-term stays, preparing food, serving alcohol for sale, guiding tours, or operating a vehicle. In some places, the host services you want to offer may be prohibited altogether. Some jurisdictions have laws that create tenancy rights for guests and additional obligations for hosts. For example, some places have landlord-tenant, rent control, and eviction laws that may apply to the host services you plan to offer. Information we provide regarding legal requirements is for informational purposes only and you should independently confirm your obligations. You are responsible for handling and using personal data of Guests and others in compliance with applicable privacy laws and these terms, including our host privacy standard. If you have questions about how local laws apply you should always seek legal advice.

You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your host. You are responsible for setting your price and establishing rules and requirements for your listing. You must describe any and all fees and charges in your listing description and may not collect any additional fees or charges outside the Villanesia platform except those expressly authorized by Villanesia. Do not encourage guests to create third-party accounts, submit reviews, provide their contact information or take other actions outside the Villanesia platform.

If you work with a co-host or host as part of a team, business, or other organization, the entity and each individual who participates in providing host services is responsible and liable as a host under these terms. If you accept terms or enter into contracts, you represent and warrant that you are authorized to enter into contracts for and bind your team, business or other organization and that each entity you use is in good standing under the laws of the place where it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions. If you instruct Villanesia to transfer a portion of your payout to a co-host or other hosts, or to send payments to someone else, you must be authorized to do so, and are responsible and liable for the payment amounts and accuracy of any payout information you provide.

Hosts and guests are responsible for any booking modifications and cancellation they agree to make via the Villanesia platform or direct Villanesia customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with a booking modification and cancellation.

After each service, guests and hosts will have an opportunity to review each other. Your review must be accurate and may not contain any discriminatory, offensive, defamatory, or other language that violates our policy. Reviews are not verified by Villanesia for accuracy and may be incorrect or misleading.

You must follow these rules and must not help or induce others to break or circumvent these rules.

  • Act with integrity and treat others with respect
  • Do not lie, misrepresent something or someone, or pretend to be someone else
  • Be polite and respectful when you communicate or interact with others
  • Do not discriminate against or harass others
  • Do not take any action that could damage or adversely affect the performance or proper functioning of the Villanesia platform

Shall you believe that a member, listing or content poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting Villanesia. In addition, if you believe that a member, listing or content has violated our standards, you should report our concerns to Villanesia. If you reported an issue to local authorities, Villanesia may request a copy of that report. Except as required by law, you agree that we are not obligated to take action in response to any report.

Shall you believe that content on the Villanesia platform infringers copyrights, please notify us in accordance with our copyright policy.

The agreement between you and Villanesia reflected by these Terms is effective when you access the Villanesia Platform for example to create an account and remains in effect until either you or we terminate the agreement in accordance with these terms.
